In Canada, the <em>United Nations Declaration on the Rights of Indigenous Peoples Act<\/em> (2021) mandates that federal laws be consistent with the Declaration. For the Revell Site Deep Geological Repository (DGR) project, UNDRIP is critical because it establishes the standard of <strong>Free, Prior, and Informed Consent (FPIC)<\/strong> for projects affecting Indigenous lands, territories, and resources [Comment Ref: <a href=\"https:\/\/www.iaac-aeic.gc.ca\/050\/evaluations\/proj\/88774\/contributions\/id\/64973\" target=\"_blank\" rel=\"noopener noreferrer\">627<\/a>, <a href=\"https:\/\/www.iaac-aeic.gc.ca\/050\/evaluations\/proj\/88774\/contributions\/id\/64950\" target=\"_blank\" rel=\"noopener noreferrer\">605<\/a>].<\/p>\n\n\n<h2 class=\"wp-block-heading\">Detailed Analysis<\/h2>\n\n\n<h3 class=\"wp-block-heading\">The Importance of UNDRIP<\/h3>\n\n\n<p>UNDRIP is essential because it shifts the regulatory paradigm from mere &#8216;consultation&#8217; to a requirement for &#8216;consent&#8217; regarding hazardous waste storage on Indigenous territories [Comment Ref: <a href=\"https:\/\/www.iaac-aeic.gc.ca\/050\/evaluations\/proj\/88774\/contributions\/id\/64973\" target=\"_blank\" rel=\"noopener noreferrer\">627<\/a>]. The NWMO\u2019s Initial Project Description (IPD) fails to provide a clear mechanism for what happens if consent is withheld by a Nation whose territory is traversed by the proposed transportation routes. Furthermore, there is a lack of clarity on how &#8216;Anishinaabe Values&#8217; are weighted against technical engineering requirements when the two conflict [Analysis: Section 4].<\/p>\n\n\n<h2 class=\"wp-block-heading\">Recommendations &#038; Mandates<\/h2>\n\n\n<p>We <strong>strongly recommend<\/strong> that the NWMO establish an Independent Consent Verification Framework. This body, governed by Indigenous legal experts and Elders, should have the authority to audit the consent process and trigger a &#8216;pause&#8217; in development if FPIC is found to be compromised. Additionally, we <strong>strongly recommend<\/strong> that the NWMO formalize a &#8216;Jurisdictional Harmonization Protocol&#8217; that maps how the RAAP (Regulatory Assessment and Approval Process) of the Wabigoon Lake Ojibway Nation integrates with federal licensing. This is necessary to prevent legal gridlock. Finally, we <strong>strongly recommend<\/strong> that the proponent expand the scope of the Impact Assessment to include all transportation corridors as a core Valued Component, ensuring that all Nations along these routes are afforded the same level of engagement and consent rights as the primary host community.<\/p>\n\n\n<h2 class=\"wp-block-heading\">Conclusion<\/h2>\n\n\n<p>The Revell Site DGR project faces a significant social license deficit. Until the NWMO moves beyond &#8216;consultation&#8217; and demonstrates a concrete, verifiable adherence to UNDRIP and FPIC, the project remains at high risk of sustained legal and social opposition. The path forward requires a fundamental shift toward co-management and the recognition of Indigenous jurisdiction as a primary, rather than secondary, project driver.<\/p>\n\n<div style=\"background-color: #f8fafc; padding: 1.5rem; border-radius: 0.5rem; border: 1px solid #e2e8f0; margin-top: 2rem;\">\n\n<h3 class=\"wp-block-heading\">About the Deep Geological Repository (DGR) for Canada&#8217;s Used Nuclear Fuel Project<\/h3>\n\n\n<p>The Nuclear Waste Management Organization (the NWMO) is proposing a new underground deep geological repository system designed to safely contain and isolate used nuclear fuel. Wabigoon Lake Ojibway Nation (WLON) and the Township of Ignace have been selected as the host communities for the proposed project, which is located 21 kilometres southeast of the WLON and 43 kilometres northwest of the Town of Ignace, Ontario along Highway 17. As proposed, the Deep Geological Repository (DGR) for Canada&#8217;s Used Nuclear Fuel Project would provide permanent storage for approximately 5.9 million bundles of used nuclear fuel. The project is expected to span approximately 160 years, encompassing site preparation, construction, operation and closure monitoring.
